The Disciplinary Panel found proved three charges based on the evidence before it.
It expelled Mr Elliot from Membership of the Institution for failure to operate the Firms' formal complaint handling procedure and for failure to co-operate with an RICS officer investigating the complaint by not responding to letters.

For failure to conduct himself in a manner befitting membership of the Institution for non-compliance with a County Court Order it imposed a Reprimand.

The Disciplinary Panel ordered Mr Elliot to contribute £3,147.63 towards costs and ordered publication in RICS Business, RICS.org and a local newspaper circulating in the local area to his business.

Mr Elliot appealed against the decision and at an Appeal Hearing on 23 September 2008, the decision of the Disciplinary Panel was upheld.

It ordered Mr Elliot to contribute to the cost of the Appeal hearing in the sum of £1,874.15 and also ordered publication in RICS Business, RICS.org and a newspaper circulating in the local area to his business.
