Modern rights of light cases are few and far between. In 2005, Midtown Limited v City of London Real Property Company Limited [2005] 1 EGLR 65 provided an interesting analysis of the factors taken into account when considering whether to award damages instead of an injunction. Then, just like London buses, three further decisions have come along providing valuable guidance on the modern judicial approach to rights to light.
